Terms of Service

These Terms of Service (“Terms”) govern your use of the TurboMade website located at turbomade.com (the “Site”) and any purchase or use of services provided by TurboMade (“we”, “us”, “our”). By accessing the Site or placing an order, you agree to these Terms.

If you do not agree, please do not use the Site.

1) Eligibility and accounts

You must be at least the age of majority in your place of residence (or have permission from a parent/guardian) to make a purchase. If you create an account, you are responsible for keeping your login details secure and for all activity under your account.

2) Orders and acceptance

When you place an order, you are making an offer to purchase. We reserve the right to accept, decline, cancel, or limit any order at any time, including for suspected fraud, unauthorized activity, or errors in product or pricing information.

Once an order is confirmed, it may enter production quickly, especially for custom items. Please review your selections carefully before completing checkout.

3) Custom and made-to-order products

Many of our products are made to order and/or customized based on the options you select and information you provide (including uploads where applicable). Because of this, some purchases are not eligible for return or refund except as described in our Returns & Refunds Policy.

By purchasing a custom product, you confirm that the customization details you submit are accurate and complete.

4) Pricing, currency, and payment

Prices are shown in the currency displayed at checkout. We may change prices at any time without notice. Taxes and shipping costs (if applicable) are shown at checkout.

Payments are processed securely through Shopify Payments and Stripe (or other payment methods shown at checkout). We do not store full payment card details.

5) Shipping and delivery

Estimated delivery timelines are provided in our Shipping & Delivery page and/or at checkout. Delivery times are estimates and may vary due to carrier delays, customs processing, weather, or other factors outside our control.

For international orders, you may be responsible for import duties, taxes, or customs fees unless clearly stated otherwise at checkout.

6) Returns, refunds, and replacements

Returns, refunds, and replacement eligibility are governed by our Returns & Refunds Policy. In general, change-of-mind returns are not accepted for custom/made-to-order items. If an item arrives damaged, defective, or incorrect, contact us within the timeframe listed in that policy so we can help.

7) User content and uploads (photos, text, designs)

If you upload photos or submit customization content (“User Content”), you represent that you own the rights to it or have permission to use it.

You grant TurboMade a limited license to use your User Content only as needed to fulfill your order, provide customer support, and handle quality issues, reprints, or replacements. We are not responsible for User Content you submit, including its legality, accuracy, or quality.

We do not accept requests to reproduce protected logos, copyrighted designs, trademarks, or other protected works unless you have the rights and can provide proof if requested.

8) Intellectual property

All content on the Site, including product designs, images, logos, text, graphics, and layout, is owned by TurboMade or used with permission and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or exploit Site content without our written permission.

9) Prohibited use

You agree not to use the Site for unlawful purposes or in a way that could harm the Site, our business, or other customers. This includes attempting to interfere with Site security, scraping, or submitting fraudulent orders.

10) Disclaimer of warranties

The Site and products are provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11) Limitation of liability

To the fullest extent permitted by law, TurboMade will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption.

In any case, our total liability for any claim relating to a product or order will not exceed the amount you paid for the product(s) that are the subject of the claim.

12) Indemnification

You agree to indemnify and hold TurboMade harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your User Content (including alleged infringement of third-party rights).

13) Changes to the Site, products, and Terms

We may update the Site, products, pricing, and these Terms at any time. When we make changes, we will update the “Last updated” date. Your continued use of the Site after changes means you accept the updated Terms.

14) Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law rules. You agree that any disputes will be resolved in the courts located in Vancouver, British Columbia, unless applicable law requires otherwise.
